If your out-of-state case needs a witness or records from Volusia County, you can get a Florida subpoena from the local Clerk without opening a case here. Our Volusia County subpoena service covers DeLand, Deltona and the rest of West Volusia.

How our Volusia County subpoena service works
- Submit the foreign subpoena to the Volusia County Clerk. Fla. Stat. § 92.251 sends it to the Clerk of Court in the county where the discovery is sought. Making the request is not an appearance in Florida’s courts.
- The Clerk issues a Florida subpoena. It mirrors the terms of your subpoena and lists the names, addresses and phone numbers of all counsel of record.
- We serve it. Service follows Florida law and the Florida Rules of Civil Procedure. Each attempt is GPS-stamped and logged.
- We return a sworn affidavit of service. Every one is checked against Fla. Stat. § 48.21 first.
Let us take it to the Clerk in DeLand
For $100 on top of the service fee, we take your paperwork to the Volusia County Clerk and have the Florida subpoena issued. Florida’s rules set what the Clerk needs, so please include:
- A prepared Florida subpoena, in duplicate, with space for the Clerk’s signature and seal
- A copy of your foreign subpoena
- For a deposition: a Notice of Taking Deposition with a certificate of service on all parties (Fla. R. Civ. P. 1.410(e))
- For records without a deposition: your Notice of Production from Non-Party and a Certificate of Non-Objection, once the objection period has run (Fla. R. Civ. P. 1.351: 10 days after delivery or email service, 15 days after mail)
- Names, addresses and phone numbers of all counsel of record
