How our Seminole County subpoena service works

  1. Take your foreign subpoena to the Seminole County Clerk. Fla. Stat. § 92.251 has the party submit it to the Clerk of Court in the county where the discovery is sought. The request is not an appearance in Florida’s courts.
  2. The Clerk issues the Florida subpoena. It uses the terms of your original subpoena and includes the names, addresses and phone numbers of all counsel of record.
  3. We serve the witness. Service follows Florida law and the Florida Rules of Civil Procedure, and every attempt is GPS-stamped and logged.
  4. You receive the affidavit of service. We check it against Fla. Stat. § 48.21 before we send it.

We can handle the Clerk step

  • A copy of your foreign subpoena
  • For a deposition: a Notice of Taking Deposition with a certificate of service on all parties (Fla. R. Civ. P. 1.410(e))
  • For records without a deposition: your Notice of Production from Non-Party and a Certificate of Non-Objection, once the objection period has run (Fla. R. Civ. P. 1.351: 10 days after delivery or email service, 15 days after mail)

Florida’s. The statute applies Florida’s laws and rules to the subpoena, and any motion to quash, modify or enforce it is heard in Florida.
