Orange County Subpoena Service for Out-of-State Cases

Your case is pending in another state, but the witness or records are in Orlando or elsewhere in Orange County. Florida has a short, clerk-based process for this, and you do not need to open a Florida case to use it. We are a certified process server on the Ninth Judicial Circuit roster, and our Orange County subpoena service covers Orlando and every city in the county.

How our Orange County subpoena service works

  1. Submit the foreign subpoena to the Orange County Clerk. Under Fla. Stat. § 92.251, a party in an out-of-state case submits the subpoena to the Clerk of Court in the county where the discovery is sought. Asking for it does not count as an appearance in Florida’s courts.
  2. The Clerk issues a Florida subpoena. It carries the same terms as your original and lists the names, addresses and phone numbers of all counsel of record.
  3. We serve it. The Florida subpoena must be served under Florida law and the Florida Rules of Civil Procedure. We serve it and record every attempt with GPS-stamped detail.
  4. You get a sworn affidavit of service. It is checked against the requirements of Fla. Stat. § 48.21 before it leaves our office.

Want us to take it to the Clerk?

For $100 on top of the service fee, we take your paperwork to the Orange County Clerk and have the Florida subpoena issued. Florida’s rules decide what the Clerk needs, so please send:

  • A prepared Florida subpoena, in duplicate, with space for the Clerk’s signature and seal
  • A copy of your foreign subpoena
  • For a deposition: a Notice of Taking Deposition with a certificate of service on all parties (Fla. R. Civ. P. 1.410(e))
  • For records without a deposition: your Notice of Production from Non-Party and a Certificate of Non-Objection, once the objection period has run (Fla. R. Civ. P. 1.351: 10 days after delivery or email service, 15 days after mail)
  • Names, addresses and phone numbers of all counsel of record

What to send us

  • The Clerk-issued Florida subpoena, or the Clerk packet above if we are taking it to the Clerk for you
  • The witness’s name and best known address in Orange County
  • The appearance or production date, so we can plan around it
  • A contact for questions, plus counsel of record for every party

Frequently asked questions

Do I need a Florida attorney to get the subpoena issued?

The statute lets a party in the out-of-state case submit the foreign subpoena to the Clerk, and the request is not an appearance in Florida’s courts. For questions about your own case, check with counsel; we cannot give legal advice.

Which Clerk do I submit it to?

The Clerk of Court in the county where the witness or records are. For Orlando and the rest of Orange County, that is the Orange County Clerk of Courts.

What law governs the Florida subpoena?

Florida’s. Section 92.251 says Florida’s laws and rules apply to subpoenas issued under it, including any motion to quash or modify, which goes to the Florida court.

Can you serve a records custodian at a business?

Yes. Tell us the company and the department or custodian named in the subpoena.
