Eviction service is governed by its own statute

Most Florida civil process is served under § 48.031 — handed to the person, or left with a co-resident aged 15 or older who is told what the papers are. Residential possession actions are different. Under Florida Statute § 48.183, if the tenant cannot be found in the county and no one 15 or older is at the residence, the summons may be attached to a conspicuous place on the property — but only after at least two attempts, made a minimum of six hours apart.

That six-hour separation is the detail most property managers have never been told, and it is the reason an eviction posting cannot happen on a single visit.

Why the paperwork decides the case

Under § 48.21, a return of service must state the date and time process was received, the date and time it was served, the manner of service, who was served, every pleading served, and the signature. Leave any of it out and the service is invalid.

It is correctable — but only by application to the court, which means a motion, a hearing, and a unit sitting occupied while you wait on the calendar. Frequently asked questions

Can a process server post an eviction summons on the door in Florida?

Yes, in a residential possession action. Under § 48.183 the summons may be attached to a conspicuous place on the property if the tenant cannot be found in the county and no one aged 15 or older is at the residence — but only after at least two attempts made a minimum of six hours apart. Posting is not permitted in ordinary civil cases.

How long does a tenant have to respond?
